1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

2. How to Enter:  (a)  Beginning on September 3, 2012, visit the contest page of www.fox17online.com, complete the official entry form and upload a photograph (the “Photo”) of your baby taken by you. Photos must be in .jpeg formats, sized between 4”x6” and 8”x10” and no smaller than 300 dpi (1200x1200 pixels). Altered or electronically enhanced images are not permitted and are subject to disqualification. One Photo entry per email address and per person.  All entries must be received via online submission September 23, 2012 at 11:59 PM EST (the “Submission Deadline”). Sponsor’s clock shall be the official clock of the Contest.

            (b)  The Entrant must be the parent or legal guardian of the child depicted in the Photo submission. The child depicted in the Photo must be between the ages of 0 and 48 months at the time the Photo was taken, and the Photo must be taken (or must have been taken) between 1/1/12 and 9/23/12. Photos may depict multiples (twins, triplets, etc.), but no other people should appear in the Photo.

            (c)  All entries must include Entrant’s name, age, address, email address, and phone number as well as the name, date of birth of the child depicted in the Photo and date Photo was taken. You must provide all information requested on the entry form, your contact information must be accurate, and you must have a valid e-mail account in order for your entry to be eligible.

            (d)  Information submitted in conjunction with this Contest will be treated in accordance with Sponsor’s privacy policies, which can be found on the Station Website. In the event of a dispute regarding the identity of an Entrant, the holder of the e-mail account through which the Photo was submitted will be deemed the Entrant.

3. Eligibility: Contest participation is limited to amateur photographers only (i.e., individuals earning 10 percent or less of his/her income from photography). This Contest is open to legal residents of Michigan, age eighteen (18) years and older at the time of entry. The Entrant must be the parent or legal guardian of the child depicted in the Photo submission. Employees of Sponsor and of its parent companies, affiliates, subsidiaries, advertising agencies, prize providers, promotional partners and/or public relations companies associated with this Contest, and their immediate family members are not eligible.

4. A potential winner may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the winning entry, and that all eligibility requirements are met. THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.

5. Selection of Winners and Notification: (a) Eligible photo submissions will be published in an online gallery on the Station Website on or about September 3, 2012, and website visitors will be invited to vote for their favorite photo submissions beginning Monday, September 24, 2012, and continuing through Sunday, September 30, 2012 at 11:59 PM EST.  The five (5) Photos that receive the greatest number of eligible votes at the close of the Voting Period will be declared Finalists.  On or about October 2, 2012, Finalists’ photo submissions will be judged by a panel consisting of FOX 17 WXMI staff members, based on the following factors: overall appearance, beauty and cuteness of the child as well as originality of the Photo. One Photo will be declared the Winner based on the results of the judging process.  The decisions of the judges are incontestable, final and binding. Sponsor reserves the right to decline to publish any Photo submission, for any reason in its sole and absolute discretion.

            (b) Sponsor will attempt to notify the potential winner by telephone or by email using the information provided in the entry form. If the potential winner cannot be reached after reasonable effort, or does not timely respond to notification attempt, or does not meet the eligibility requirements, or does not adhere to the Official Rules, or if the prize notification is returned as undeliverable, that Entrant will be disqualified and Sponsor will select a new winner by the same criteria set forth above. Winner will be required to sign and return a Photo Release, Affidavit of Eligibility, Liability Release and (where legal) a Publicity Release on behalf of him/herself and the child depicted in the Photo. Failure to provide proof of identity, eligibility and compliance with the requirements of these Official Rules, or to return all required documents by 5:00 PM EST on October 19, 2012 will result in disqualification.

            (c) Voting will be open to all users of the Station Website. One vote per person per valid email address. Votes in excess of this limit will not be counted. Voters must be located in the United States at the time a vote is submitted.

6. Prize:  Subject to eligibility verification and compliance with these rules, Winner will receive a Beautiful Babies prize pack which includes: (a) $1,000; (b)AppleTree Learning Center Gift Basket including coffee mug, water bottle, travel mug, lunch tote, grocery bag, not pad, Pedal the Rabbit plush toy, Kaplan Early Learning Company’s current infant/toddler catalog, Kaplan early Learning Company gift card $50, and coupon for $50 off tuition at an AppleTree Christian Learning Center (ARV: $100); (c) $50 gift card to the Gilmore Collection and 4 hours professional babysitting provided by Northlight Nannies (ARV: $100); (d) $100 Gift card to For the Kids Gymnastics and Trampoline (ARV: $100); and (e) a Free Baby photo session provided by Noun Studios (ARV: $150).  Approximate retail value of prize pack: $1,550. Sponsor reserves the right to substitute a prize of equal or greater value in the event that the prize or portion thereof is unavailable. Winner is responsible for applicable federal, state and local taxes in connection with receipt and use of the prize, and may be required to complete a W9 Form (available at http.//www.irs.gov/pub/irs-pdf/fw9.pdf).  Winners who receive prizes valued at $600 or more will receive a 1099 tax form.  Winner will be responsible for any and all additional prize-related expenses not mentioned in this Paragraph. All properly claimed prizes will be awarded, but in no event will Sponsor awards more prizes than are provided for in these Official Rules.

7. Other Conditions of Entry: By entering, each Entrant represents and warrants that no laws were broken in the creation of the Photo and that the Photos is his/her own original creation, has not been copied in whole or in part from any other work, does not violate the rights of any person or entity (including but not limited to privacy rights and copyrights), does not defame, libel, or slander anyone or any entity, and does not contain inappropriate, offensive, indecent, vulgar, obscene or profane content. Photos that do not comply with these Official Rules or the foregoing representations and warranties shall be disqualified. Each Entrant agrees to indemnify, defend and hold Sponsor harmless against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys' fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to a breach of the foregoing representations and warranties. All entry information (except Photo submissions) becomes the property of the Sponsor and will not be returned or acknowledged. By entering, each Entrant grants to the Sponsor a world-wide, perpetual, royalty-free license to publish his/her Photo submission on the Station, on the Station Website and through any and all other media, now known or hereafter devised, in any manner related to the Contest, without prior notice, approval or compensation. Entrants otherwise will retain all rights to their respective Photos. Sponsor reserves the right at its sole discretion, to disqualify and prohibit any Entrant from participating in the Contest, and to prohibit any voter from voting in the Contest if it believes or finds such Entrant or voter to be tampering with the entry or voting process or if such individual shows a disregard for, or attempts to circumvent, these Official Rules, or if such Entrant or voter acts in a manner the Sponsor determines to be not fair or equitable, or in a manner to annoy, threaten or harass any other entrant, voters or Sponsor, or in any other disruptive manner. 

8. Release: By entering, each Entrant agrees on behalf of him/herself and the child portrayed in the corresponding Photo submission, to release, waive, and hold harmless Sponsor and its affiliates, subsidiaries, parent companies, advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents from and against any and all claims, losses, damages, and liability arising from injuries, damages, costs, or expenses of any kind (including without limitation attorney’s fees) incurred as a result of the Entrant’s participation in this Contest and/or their acceptance, use, or misuse of any prize or element thereof.

9. Publicity: By entering this Contest, each Entrant agrees on behalf of him/herself and the child portrayed in the corresponding Photo submission, to allow use of their and their child’s name, voice, photograph, likeness, any information provided on entry form, and their Contest Photo submission in any medium of communication, including but not limited to print, Internet, radio and/or television and for any purpose, including advertising, promotional or other purposes, by Sponsor or and its licensees and affiliates, without additional compensation.

10. Internet: If for any reason, the Internet-related portion of this Contest is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Contest, Sponsor reserves the right, in its sole discretion, to terminate or suspend the Contest or any portion of the Contest. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS CONTEST WILL RESULT IN DISQUALIFICATION. Sweepstakes rules shall be governed and enforced pursuant to Michigan laws, excluding choice of law provisions.
